When most people finally check “write a will” off their to-do list, they breathe a sigh of relief. But here’s the big question: does a will ever expire?
The short answer is no—a will doesn’t have an expiration date. But here’s the catch: a will that’s old, outdated, or no longer reflects your life today can create just as many problems as not having one at all.
And since August is National Make-a-Will Month, now is the perfect time to ask yourself: When’s the last time I looked at mine?
Why Wills Don’t Expire—but Do Go “Stale”
Legally speaking, wills remain valid until you revoke them. However, life moves fast. Marriage, divorce, children, buying a home, even starting a business—all of these major life events should trigger a review of your estate plan.
Ask yourself:
- Have I had any big life changes in the last 3–5 years?
- Do the people I’ve named in my will still reflect my wishes?
- Have any of my beneficiaries passed away, moved, or changed circumstances?
If you answered “yes” to any of these, it might be time to update your plan.
When Should You Update Your Will?
Think of your will like a living document. You don’t need to rewrite it every year, but you should review it regularly. A good rule of thumb: check in every 3–5 years or when a major life event happens.
Examples of life events that call for an update:
- Marriage, divorce, or remarriage
- Birth or adoption of a child
- Buying or selling property
- Starting or closing a business
- Changes in state laws that could impact your estate
💡 Engagement prompt: Which of these life changes have you experienced recently? Could your will be out of date without you realizing it?
Real-Life Why Updating Your Will Protects Your Loved Ones
One of the biggest reasons families end up in probate court battles is because a will didn’t match the family’s current situation. Outdated wills can:
- Leave out younger children or grandchildren
- Give assets to an ex-spouse unintentionally
- Create confusion if property was sold or inherited differently
- Cause delays, disputes, and unnecessary expenses
Reflection question: Would your will—if read today—truly reflect your wishes?
