Heirs property happens when land or a home is passed down without a clear will or legal title. Instead of one documented owner, multiple heirs inherit the property together—often without formal legal agreements. While this may seem harmless at first, it creates major risks. The property becomes vulnerable to forced sales, disputes, and exploitation by outside investors. In fact, heirs property is one of the leading causes of Black land loss in the U.S.
The Cultural Silence Around Death
Let’s be real: in many of our communities, talking about death can feel like inviting it in. We’ve all heard phrases like “Don’t call the Grim Reaper!” or “Don’t tell the Lord you’re ready yet!” These jokes reflect a deeper discomfort—and stigma—around planning for what happens after we’re gone. But that discomfort comes at a cost.
By avoiding conversations about wills and estate planning, families often leave behind confusion, conflict, and lost property. When no plan is in place, the state steps in—and their plan rarely reflects what you would’ve wanted for your loved ones.
“Estate Planning Is for Rich Folks”—Not True.
Another dangerous myth? That estate planning is only for the wealthy. Many families believe if they don’t have a big bank account or own multiple properties, there’s no need to plan. But if you have a home, land, savings, or even a life insurance policy—guess what? You have an estate.
And if you don’t decide what happens to it, someone else will.
The Legal System Isn’t Always on Our Side
Let’s also acknowledge the elephant in the room: distrust in the legal system is real. Generations of inequality, discrimination, and redlining have created valid skepticism, especially among Black families. But that mistrust can sometimes lead us to avoid legal tools altogether—tools that could actually protect our property and families.
That avoidance is part of what allows heirs property issues to continue unchecked. Without clear titles and legal protections, families are left vulnerable to land grabs, court battles, and outside investors who know exactly how to take advantage of the situation.
We Think We Have More Time
“I’ll handle it next year.”
“We’ll talk about it after the holidays.”
“I’m not going anywhere anytime soon.”

The truth is, none of us know how much time we have. And while it’s uncomfortable to think about, estate planning is one of the most loving, protective things you can do for your family. It’s not just about death—it’s about making sure your life’s work benefits the people you care about, not the probate courts or developers.
What Can You Do About It?
- Start the conversation. Don’t wait until a crisis to talk about legacy.
- Create a will or trust. Even a basic plan is better than none.
- Educate your family. Help others understand the risk of heirs property.
- Get help from trusted professionals. Look for lawyers, real estate experts, and financial planners who understand your values and culture.
Heirs property might be a silent wealth killer—but it doesn’t have to be. When we talk about legacy, we’re really talking about love. Let’s protect both.
